Bentley Higgs' partners have provided Expert Witness reports for the legal profession and courts for over 25 years, offering independent, constructive reports and opinions on industrial, commercial and residential property matters.
Our expertise covers most areas of commercial property consultancy, including valuation, lease renewal proceedings and rent review third party disputes. We can represent clients in High Court, County Court, Public Enquiries and Lands Tribunals.
Compulsory Purchase
With experience from both sides, acting on behalf of Local Authorities, Public Statutory Bodies and for clients, we have extensive experience in the Compulsory Purchase Sector.
We will advise you on the following as appropriate:
- The entire CPO process
- How to object to a CPO
- How to adopt the right strategy and tactics to achieve your objectives
- Assess your compensation entitlement including the level of business disturbance
- Negotiate with the acquiring Authority to maximise your compensation claim
- If it is appropriate and how to apply to the Planning Authority for a "Certificate of appropriate alternative development"
- Where settlement through negotiation is not possible, we will advise on the Lands Tribunal process, liaising with your legal advisers and acting as Expert Witness.
Property Acquisitions
If you are looking to re-locate or move to the area, we would be happy to carry out property searches, advise on likely occupation costs including rent, rates, service charges etc, identify properties and negotiate with vendors/landlords to secure the best possible terms in current market conditions, liaise with your legal advisers with regard to Heads of Terms and any matters of concern.
